1. Introduction
By using TanSmarter, you confirm your acceptance of, and agree to be bound by, these terms and conditions.
2. Agreement to Terms and Conditions
This Agreement takes effect on the date you first use the TanSmarter application.
3. License and Termination Rights
The TanSmarter app is provided solely for personal use to help you tan safely and effectively. You may use the app's functionalities as provided, subject to these terms. TanSmarter retains the right to terminate or restrict your access to the app at any time without prior notice. This enables TanSmarter to ensure responsible and appropriate usage of the app.
4. Fees and Access
TanSmarter is a paid app. Access to its features requires an active subscription or a one-time lifetime purchase. Any paid offer shows its price, billing period, renewal terms, and cancellation options before you buy.
TanSmarter currently offers:
- Weekly, billed every week
- Yearly, billed every 12 months, with a 7-day free trial for eligible new subscribers
- Summer Pass, billed once for 6 months, with a 7-day free trial for eligible new subscribers
- Lifetime, a single purchase with no recurring billing
Prices are shown in the app in your local currency before purchase and may vary by region.
Automatic renewal
The weekly, yearly, and Summer Pass options are auto-renewable subscriptions. Payment is charged to your Apple Account at confirmation of purchase. A subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price for the same plan.
You can manage your subscription and turn off auto-renewal in your Apple Account settings after purchase. Cancelling stops future renewals; it does not shorten or refund the period you are already in.
Free trials
Where a free trial is offered, it is available once per Apple Account per subscription group and only to subscribers who have not already used an introductory offer. Unless you cancel at least 24 hours before the trial ends, the subscription begins automatically and your account is charged at the standard price. If you buy a subscription before a free trial ends, the unused portion of that trial is forfeited.
Payment, refunds, and restoring purchases
Purchases are processed by Apple, not by TanSmarter. Billing, renewals, cancellations, refunds, and purchase restoration are handled according to Apple's terms and your Apple Account settings. Refund requests are made to Apple. You can restore a previous purchase from the purchase screen in the app.
Users from before TanSmarter charged
Accounts created before TanSmarter introduced paid access keep access to the app without a purchase. This is granted at TanSmarter's discretion and applies to the account, not to a device or a person.
5. Service Availability and Updates
TanSmarter may modify, improve, suspend, or discontinue parts of the service over time. We may also add, remove, or change features as the product evolves.
We will make reasonable efforts to communicate material changes that affect user access or core functionality.
6. Disclaimer
TanSmarter does not warrant that the app will meet your specific requirements or that its operation will be uninterrupted or error-free. All express and implied warranties or conditions not expressly stated in this Agreement, including but not limited to loss of data or any interruption of service, are excluded to the maximum extent allowed by law. This Agreement does not affect your statutory rights.
Important Health Disclaimer: TanSmarter provides UV index information and tanning session recommendations for general guidance only. This app is not a substitute for professional medical advice. Users should consult with healthcare professionals regarding sun exposure, especially those with skin conditions, a history of skin cancer, or sensitivity to UV radiation. Always use appropriate sun protection and follow dermatological recommendations.
7. Warranties and Limitation of Liability
TanSmarter does not provide any warranty, guarantee, or other terms regarding the app's quality, suitability for any purpose, or functionality. TanSmarter is not liable for any indirect, special, or consequential losses or damages arising from the app's use, including but not limited to sunburn, skin damage, or any health-related issues from sun exposure. Should TanSmarter be deemed liable for a breach of this Agreement, you agree that any liability will be limited to the amount actually paid by you for any paid features or services in the app, if any. You hereby release TanSmarter from any and all obligations, liabilities, and claims beyond this limitation.
8. Responsibilities
TanSmarter is not responsible for any actions taken by users based on UV data or tanning recommendations generated within the app. Users are solely responsible for their sun exposure decisions and should always exercise appropriate caution.
9. Weather Data and Third-Party Sources
TanSmarter displays UV index, temperature, and forecast information supplied by third-party weather providers, and derives tanning windows, session durations, and SPF guidance from that information. Depending on your device, region, and app version, weather data may be provided by Apple Weather or by OpenWeather.
Where weather data is supplied by Apple Weather, your use of that data is also subject to Apple's terms. Apple's weather data sources and legal attribution are available at https://developer.apple.com/weatherkit/data-source-attribution/. Where weather data is supplied by OpenWeather, it is subject to OpenWeather's terms, available at https://openweathermap.org/terms. By using TanSmarter you agree to the terms of the applicable weather data provider.
Weather data is provided on an "as is" basis. TanSmarter does not control, and is not responsible for, the accuracy, availability, or timeliness of data supplied by these providers. Recommendations derived from weather data are modified by TanSmarter and are not the original data of the provider.
10. Pricing Changes
TanSmarter may add, remove, or change free and paid features over time. We will make reasonable efforts to communicate material pricing or access changes before they affect you. Existing subscriptions remain subject to the renewal and cancellation terms shown at purchase and managed through the applicable app store or payment provider.
11. General Terms and Law
This Agreement is governed by the laws of South Africa. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and TanSmarter as a result of your use of these services. You agree not to represent yourself as a representative, agent, or employee of TanSmarter and acknowledge that TanSmarter is not liable for any act or omission by you.
